Sunapee Man Faces Second-Degree Assault in I-89 Crash
North Haverhill — A Sunapee man who authorities allege intentionally drove his truck across the median of Interstate 89 and struck another car, has been indicted by the Grafton County grand jury on two second-degree murder charges and a second-degree assault charge relating to the stillbirth of a fetus.
Robert J. Dellinger, 53, was previously charged with two counts of second-degree murder in the December accident that killed Amanda Murphy, 24, and her fiance Jason Timmons, 29.
Dellinger now faces a felony charge of second-degree assault that relates to Murphy and the death of her unborn child.
Murphy was eight months pregnant at the time of the accident, and the female fetus did not survive.
The assault charge alleges that Dellinger recklessly caused injuries to Murphy’s abdomen, resulting in a skull fracture to the fetus and its stillbirth.
Under New Hampshire law, homicide charges may not apply to the death of a fetus. A person can be charged for second-degree assault in New Hampshire if they recklessly or negligently cause injury to another resulting in a miscarriage or stillbirth.
An indictment is not a finding of guilt, but a tool for prosecutors to continue with criminal cases.
Authorities have said that Dellinger, a former Fortune 500 executive, was depressed and contemplating suicide on Dec. 7 when he crossed the grassy median on I-89 between exits 18 and 19 in Lebanon and collided with an oncoming vehicle.
The two second-degree murder counts assert that Dellinger recklessly caused the death of Timmons and Murphy, “under circumstances manifesting an extreme indifference to the value of human life.”
The indictments allege that Dellinger drove his Chevrolet Silverado at a high rate of speed across the median into oncoming traffic in the northbound lane, causing the death of Timmons and Murphy.
Dellinger has an arraignment scheduled at 8:30 a.m. on May 12, at which time he could enter a plea. He is being held without bail.
